About the Issues
Warning Letters:
Warning letters can be sent to distributors who seem to be distributing or
selling your product incorrectly. If you have redistribution agreements or
agreed upon pricing levels with resellers, a warning letter might be the right
message to send if a reseller seems to stray from the agreement. A
warning letter can be friendly, educational and open a channel of
communication, preventing future problems.
Cease and Desist Notices:
A cease and desist letter might be issued when you have evidence that
fraud, breach of contract and/or intellectual property violations are taking
place. Serving notice lets the recipient know you are serious about
protecting your company and that you will consider any future infringements
to be willful. This can be a valuable step to show a court how you tried to
resolve a conflict before turning to an escalated legal recourse.
